Chicago SHRM’s Legislative Committee will continue its discussion of the latest issues employers face as employees return to work during the COVID-19 pandemic.

Aaron Gelb will provide an OSHA enforcement update, discussing how the agency is investigating COVID-related fatalities and workplace clusters, employee complaints and the already existing safety and health standards implicated by the pandemic.  Aaron will also discuss—based on personal experience—how OSHA is conducting traditional inspections of workplace fatalities, amputations and hospitalizations as hotspots flare across the country.

Karen Byron and Dave Moore will provide updates regarding the ADA and the FFCRA, including the impact of the recent federal court ruling striking down certain provisions the DOL’s FFCRA regulations, how to communicate with employees about the reasons why they are unable to return to work onsite without running afoul of the ADA and the FFCRA, and what steps employers can take under the ADA to screen employees for COVID-19 when they do return to work.

Christina Murdoch will be speaking about COVID’s current effect on the ability of foreign nationals to travel to and work in the United States, including its effect on I-9 compliance and maintenance of employment authorization for foreign workers.
